Terms of Service
Byron Web Studio ("we", "us") is a sole trader business operating in Byron Bay, NSW, Australia. ABN: [your ABN here]. By engaging us to design, build, or host a website, you ("you", "the customer") agree to these terms.
1. Scope of services
We design, build, and host one-time custom websites at three fixed-price tiers ("Refresh", "Rebuild", "Full Suite"). The specific deliverables for each tier are listed on our website at the time of purchase.
Anything not explicitly listed in your tier is out of scope. Out-of-scope work — additional pages, custom integrations, branding, copywriting beyond your existing content, photography, ongoing maintenance, third-party costs (e.g. Google Workspace, premium fonts) — is quoted separately at our standard hourly rate or as a fixed-price add-on.
2. Timeline
Build timelines (7, 10, or 14 days depending on tier) start when we receive a complete intake form. If we are waiting on photos, copy, or other content from you, the timeline pauses until we receive what we need.
3. Revisions
The number of included revision rounds is listed against each tier on our website at the time of purchase. A "round" is one batch of revision requests, replied to within 48 hours of the preview email. Revisions outside the included window or rounds are quoted at $50/round.
4. Hosting and domains
The price you pay includes hosting for 12 months from the day your site goes live. From month 13 we charge an annual hosting fee (see our website for current rates). If you do not renew hosting, your site will be taken offline 14 days after the renewal due date.
Where we register a domain on your behalf, the domain is registered in your name (or in our name with you as the beneficial owner under auDA "agent" arrangements) and you remain the legal registrant. Domain renewal fees are passed through at cost.
Where you retain your existing domain, you remain responsible for it. We will provide DNS instructions to point your domain at our hosting; we do not change DNS records on your behalf without explicit written instruction.
5. Refunds
You may cancel and receive a full refund at any time within 7 calendar days of payment, provided your site has not yet been deployed to a live URL. Once your site is live on your domain, the price paid is non-refundable except as required by Australian Consumer Law.
If we cannot complete the build for reasons within our control (including inability to deliver the agreed scope), we will refund the unworked portion in full.
6. Intellectual property
You own the content you supply (copy, photos, brand). We grant you a perpetual licence to the design and code of your final delivered website for use on the agreed domain. We retain the right to reuse our underlying templates, components, and engineering work for other clients.
Where your site uses third-party stock photography curated by us, those photos are licensed for use on your site only — not for separate redistribution.
7. Liability
Our liability under these terms is capped at the amount you paid us. We are not liable for indirect or consequential losses (lost profits, lost customers, lost data) except where prohibited by Australian Consumer Law.
We make reasonable efforts to keep your site online but do not guarantee 100% uptime. Where our hosting provider experiences an outage, we work to restore service as quickly as possible.
8. Customer obligations
You confirm that all content you supply (copy, photos, logos, business information) is owned by you or properly licensed. If a third party makes a copyright claim against your site for content you supplied, you are responsible for resolving it and indemnifying us against any costs we incur.
9. Termination
Either party may terminate the agreement in writing if the other party materially breaches these terms and does not cure the breach within 14 days of written notice.
If you choose to leave us after launch and want to take your site to another host, we charge a one-time export fee of $99 in exchange for a static export of your site, all content, and assistance transferring your domain to your preferred registrar.
10. Governing law
These terms are governed by the laws of New South Wales, Australia. Any dispute is to be resolved in the courts of New South Wales.
11. Changes to these terms
We may update these terms from time to time. The version applicable to your engagement is the version on our website at the time of your purchase. We retain a dated copy of every version.
